3. Nature of Service (e-SIM)

Noesime provides digital e-SIM (Embedded Subscriber Identity Module) profiles.

  • No Physical Shipping: No physical SIM cards are provided. Delivery is strictly digital via QR code or manual activation code.
  • Intermediate Service: We act as a service provider utilizing global carrier networks. We do not own the physical telecommunications infrastructure.

4. User Responsibilities & Device Compatibility

Before purchasing, you are responsible for:

  • Device Eligibility: Ensuring your device is e-SIM compatible and network-unlocked.
  • Account Security: Maintaining the confidentiality of your Noesime account and ensuring your email address is correct for QR code delivery.
  • Accuracy: Providing the correct device identifiers (EID/IMEI) if required for specific regional plans.

5. Usage Policy & Fair Use

  • Data Limits: Your plan is limited to the data volume and time duration (e.g., 7 days, 30 days) purchased. Unused data expires at the end of the term.
  • Fair Usage: We reserve the right to throttle or suspend access if usage is deemed abusive, involves illegal activities, or negatively impacts the local carrier network.
  • Prohibited Use: You may not use Noesime services for bulk messaging, automated M2M operations (unless specified), or bypassing network security protocols.

6. Pricing and Payment

  • Currency: Prices are displayed in [EUR/USD/SEK] as indicated on the site.
  • Taxes: For EU customers, VAT is applied based on your country of residence in accordance with EU Digital Service rules.
  • Payment: Access to the e-SIM QR code is granted immediately upon successful payment confirmation.

7. Digital Delivery & Activation

Upon payment, your e-SIM profile is delivered via email or your user dashboard.

  • Point of Delivery: Delivery is considered complete when the QR code or activation details are generated and sent.
  • Installation: You are responsible for following the provided instructions to install the e-SIM. Connection is subject to local network availability in the destination country.

8. Refund Policy (Digital Telecommunications)

In accordance with EU consumer law, by scanning the QR code or adding the e-SIM to your device, you expressly consent to begin the service and acknowledge that you lose your right of withdrawal (refund).

  • Incompatibility: Refunds are not issued for devices that are locked or incompatible with e-SIM technology.
  • Technical Errors: Refunds are only considered if a technical failure on our side prevents activation and cannot be resolved by our support team.

9. Limitation of Liability

To the maximum extent permitted by Swedish law, Noesime shall not be liable for:

  • Loss of connectivity due to local carrier maintenance or geographic “dead zones.”
  • Any indirect or consequential damages resulting from a lack of internet access during travel.
  • Unauthorized use of your data plan due to your device being lost or stolen. Our total liability is limited to the amount paid for the specific data plan in question.

10. Indemnity

You agree to indemnify Noesime and Zinspilot Sverige AB against any claims, losses, or legal fees arising from your breach of these Terms or your use of the service in violation of international telecommunications laws.

11. Termination

We reserve the right to terminate your access to our services without a refund if you are found to be in breach of Section 5 (Usage Policy) or if we detect fraudulent payment activity.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Sweden. Any disputes shall be settled in the courts of Stockholm, Sweden, unless mandatory local consumer protection laws in your jurisdiction dictate otherwise.

13. Changes to Terms

We may update these Terms to reflect changes in carrier partnerships, EU telecommunications regulations, or tax laws. Continued use of the site or active e-SIM profiles after an update constitutes acceptance.
